Australia Government Cancels Djokovic’s Visa for the Second-time

On Friday, World No.1 Novak Djokovic’s visa is cancelled by the Australian government for the second time. This latest development has made his participation in the Australian Open 2022 once again uncertain.

However, Djokovic still has the option to legally challenge the decision of visa cancellation to avoid deportation from the country and get a chance of defending this Australian Open title. 

Immigration Minister Alex Hawke made the use of his discretionary powers to again cancel Djokovic’s visa following the quashing of an earlier revocation and release from immigration detention on Monday. “Today I exercised my power under section 133C(3) of the Migration Act to cancel the visa held by Mr Novak Djokovic on health and good order grounds, on the basis that it was in the public interest to do so,” Hawke said in a statement

Australia Prime Minister Scott Morrison had made it clear on Thursday that the government’s stance on the entire visa row has not changed. His comments had surfaced after the draw for the Australian Open got delayed without any explanation.

After the news of second-time visa cancellation became public, Australian cricketer Shane Warne tweeted, “Novak is a great tennis player & one of the all times greats. No doubt. But he’s lied on entry forms, been out in public when he knew he had Covid & is now facing legal cases. He’s entitled to not be jabbed but Oz is entitled to throw him out! Agree? #shambles”

Last week, Djokovic arrived at Melbourne Airport to attend the Australia Open with a medical exemption to requirements for visitors to be inoculated against COVID-19. However, upon his arrival, Australian Border Force officials decided to revoke his medical exemption and held him alongside asylum-seekers at an immigration detention hotel for several days.    

Djokovic’s lawyers are likely to challenge the cancellation in the Federal Circuit and Family Court as they successfully did in the case of the first cancellation. It is the second time Djokovic has faced visa cancellation since he arrived in Melbourne a week ago to defend his Australian Open title.
